MODEL WEED AGREEMENT

We developed this model agreement to provide general guidance to County Engineers and Boards who wished to work with their Weed Control Districts in providing noxious weed control across multiple lines of responsibility.

 

The document recognizes that both County Engineers and Noxious Weed Control Boards must meet specific statutory responsibilities.  We designed it to avoid conflicts both with state law and with their individual responsibilities.  At the same time, our goal is to provide a mechanism that will enable their mutual efforts.

 

CRAB offers its review of your use and modification of this document should you choose this direction.  However, we are not in a position to provide legal counsel.

 

Counties who wish to use this type of arrangement for noxious weed control should be very careful about modifying the document in such a way that internal legal conflicts arise.  We strongly recommend that before doing so, you work with your County Prosecutor’s Office to assure that any structural changes to the agreement will meet both the letter and intent of the statutory requirements of the various offices.
